How Long Does a Moving Violation Stay on Your NJ Record?

The short answer: forever, on the MVC abstract. But the active points attached to a moving violation reduce after three years without a new conviction. And insurance carriers’ look-back windows are typically shorter than the MVC’s permanent record-retention. This post walks through the timeline.

MVC Abstract Retention
The Motor Vehicle Commission maintains a Driver History Abstract on every NJ-licensed driver. The abstract retains conviction records permanently — there is no automatic expiration of NJ moving-violation conviction entries. The abstract shows:
- All convictions with dates, statutes, and points originally assessed
- License-status events (suspensions, restorations)
- Surcharge balances
- Current point total
Even a moving-violation conviction from 1995 will appear on a 2025 abstract pull. The retention is permanent.
Active Points vs Permanent Record
The distinction matters:
- Permanent conviction record — stays forever
- Active point total — reduces by 3 after every 3 years without a moving-violation conviction
So a 2020 conviction that originally added 4 points to your active total has, by 2024 (with no intervening conviction), already reduced. The conviction is still on the abstract, but it’s not adding to your current point exposure.
Insurance Look-Back
Insurance carriers’ look-back windows vary by carrier and by state filing. Typical NJ private-passenger ranges:
- Surcharge look-back (carrier surcharge for points/violations): 3-5 years
- Underwriting look-back (carrier non-renewal decisions): 3-5 years
- Tiered-product look-back (whether you qualify for the carrier’s preferred tier): 3-7 years
Insurance carriers reorder their internal tier when a violation “ages out” of the look-back window even though the underlying conviction remains on the abstract.
Surcharge-Program Retention
The Surcharge Program under N.J.S.A. 17:29A-35 runs three-year billing for many surcharge-triggering convictions. Once the three-year cycle completes, the surcharge bill stops, but the underlying conviction remains on the abstract.
Expungement and Sealing
NJ’s expungement statute, N.J.S.A. 2C:52, applies to 2C (criminal-code) offenses. Title 39 traffic offenses are not eligible for expungement. The MVC abstract is permanent for the covered offenses.
For employment screening that pulls only criminal records (not driving records), traffic convictions don’t appear. For employment screening that includes a driving-record check, they do.
What Survives a Long Time
Specific high-impact retention:
- DWI convictions — permanent on abstract, 10-year look-back for DWI sentencing-tier purposes (with step-down doctrine modifying)
- Refusal convictions — same as DWI in retention
- Suspended-license convictions — permanent on abstract; can be relevant for tier-2 / tier-3 future enhancement
- CDL DUI — federal CDLIS retention is permanent
Practical Strategy
When facing a moving violation:
- Check current point total before deciding plea posture
- Audit prior 3-year window — if a violation is about to “reduce off” your active points, the timing matters
- Plea-negotiate to no-point alternative when possible — the abstract entry stays, but points and surcharge avoided
Frequently Asked Questions
Can I get a NJ moving violation expunged?
No. Title 39 is not eligible for expungement.
Will my insurance carrier see all of my history?
Carriers pull the abstract; they see everything on it. Their internal use of that data is bounded by their underwriting and surcharge-tier rules.
What if I move out of state?
NJ retains the record. If you re-license in another state, that state may pull the NJ abstract via the National Driver Register.
Do points transfer if I get a new license type?
Within NJ, the abstract follows the driver. CDL holders carry their record on both their CDL and through the federal CDLIS.
