Privacy practices of Avery & Avery, Esqs., including how we collect, use, and protect personal information from website visitors and prospective clients.

This privacy policy describes how Avery & Avery, Esqs. (“the firm,” “we,” “our”) collects, uses, and protects information from visitors to averylaw-nj.com (the “site”) and from prospective clients who contact us through the site, by phone, or in person.

1. Information We Collect

1.1 Information you give us

When you call (201) 943-2445, complete a consultation form, send us an email, or otherwise contact us, we may collect:

  • Your name, phone number, and email address
  • The basic facts of the matter you are inquiring about
  • Any documents (complaints, citations, accident reports, court orders) you choose to share with us at intake

This information is collected only to evaluate whether we can represent you and to set up a first consultation.

1.2 Information collected automatically

The site collects standard server log data including IP address, browser type, pages viewed, and timestamps. This is used for security, diagnostics, and traffic analytics. We do not associate server log data with the matter information you share at intake.

1.3 Cookies

The site uses functional cookies to remember basic session data (e.g., form state) and may use first-party analytics cookies to measure site usage. We do not use third-party advertising cookies. You may disable cookies in your browser; the site will continue to function.

2. How We Use Information

We use information you provide to:

  • Evaluate whether your matter is one we can represent you in
  • Conduct conflict-of-interest checks before retaining you
  • Communicate with you about your matter or prospective matter
  • Maintain the firm’s records as required by NJ Court Rules and the Rules of Professional Conduct

We do not sell, rent, or trade your information.

3. Confidentiality of Prospective-Client Information

Information you share with us during a consultation — even if we do not ultimately represent you — is treated as confidential under NJ Rules of Professional Conduct, RPC 1.18 (Duties to Prospective Clients). We will not represent any opposing party in the same matter and will not disclose your matter information to third parties.

4. Information Sharing

We share information only as required:

  • With our attorneys and staff working on or evaluating your matter
  • With third-party service providers (e.g., document hosting, email systems) bound by confidentiality obligations consistent with the RPC
  • As required by law, court order, or subpoena

5. Data Security

We use reasonable technical and administrative safeguards to protect the information we hold, consistent with the firm’s obligations under the RPC and applicable law. No system is perfectly secure, however, and we cannot guarantee that information transmitted over the internet is fully protected in transit.

6. Data Retention

Matter records are retained for the period required by NJ RPC 1.15 (safekeeping property) and R. 1:21-6 (recordkeeping), and for any longer period required by the matter’s substantive law (e.g., trust accounting records, case files in matters with appellate exposure). Prospective-client information for matters where no engagement results is retained for the period required to complete conflict checks and firm records, then disposed of securely.

7. Your Rights

You may at any time:

  • Request a copy of the personal information we hold about you
  • Ask us to correct inaccurate information
  • Ask us to delete information that is not subject to a retention obligation under the RPC or applicable law
  • Withdraw a prospective-client inquiry (the consultation remains confidential under RPC 1.18 regardless)

8. Children’s Privacy

The site is not directed to children under 13 and we do not knowingly collect personal information from children under 13.

9. Changes to This Policy

We may update this privacy policy from time to time. The effective date at the top of the page reflects the date of the most recent update. Material changes will be flagged on the homepage for at least 30 days following the change.
