NJ Marijuana Expungement After Legalization — Step-by-Step

The 2021 CREAMM Act (Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act, P.L. 2021, c.16) legalized adult recreational marijuana in NJ and put in place an expedited expungement framework for prior marijuana convictions. The Act includes both automatic state-level expungement of specific convictions and an expedited petition process for individuals. This post walks through the framework.

What CREAMM Did

The CREAMM Act:

  • Legalized adult recreational possession of marijuana under 6 ounces
  • Decriminalized possession amounts above the recreational limit but below distribution thresholds
  • Authorized expungement of many prior marijuana convictions
  • Required the NJ Administrative Office of the Courts (AOC) to process automatic expungements for specified categories

Automatic Expungement

Under the CREAMM provisions, certain marijuana convictions were processed for automatic expungement by the AOC without individual petitions. The categories:

  • Pre-CREAMM possession-only convictions for amounts now recreationally legal
  • Specific lower-tier distribution charges below post-CREAMM thresholds
  • Pre-CREAMM paraphernalia charges

Automatic expungement processing has been ongoing since CREAMM’s effective date.

Expedited Petition Expungement

For convictions not covered by automatic processing, individuals can petition for expedited expungement. The process:

  1. Eligibility audit — verify offense type, conviction date, and post-CREAMM treatment
  2. Petition filing under the CREAMM expedited framework
  3. Court review — typically faster than standard 2C:52 timelines
  4. Order signing and distribution

The expedited process bypasses standard 2C:52 waiting periods for marijuana matters.

What Remains

Some marijuana matters are not eligible for the expedited process:

  • Distribution-quantity convictions above post-CREAMM trafficking thresholds
  • Convictions involving minors
  • Convictions involving driving under the influence — marijuana DWI under N.J.S.A. 39:4-50 is a Title 39 traffic matter not eligible for expungement
  • Convictions involving school zones above specific enhancement thresholds (some retroactive relief available)

For these categories, standard 2C:52 expungement may apply at the standard waiting periods.

Practical Strategy

For petitioners with pre-CREAMM marijuana convictions:

  1. Pull current criminal record — verify whether automatic expungement has been applied
  2. Identify any remaining marijuana matters — these may be eligible for expedited or standard expungement
  3. File comprehensive expungement — combine marijuana expungement with any other eligible 2C:52 expungement matters
  4. Verify post-order distribution — confirm the expungement order has been distributed to the State Police, FBI, and other listed agencies for sealing

Federal Implications

Marijuana remains Schedule I under federal law (21 U.S.C. § 812). NJ expungement of state-level marijuana convictions does not automatically remove the federal record. Federal contexts (immigration, federal employment, federal firearms) may continue to access the underlying conviction.

Other Post-CREAMM Issues

Driving Under the Influence

N.J.S.A. 39:4-50 continues to prohibit operation under “narcotic, hallucinogenic or habit-producing drug” — including marijuana. The CREAMM Act did not legalize drugged driving.

Workplace Drug Testing

Employers retain certain rights under post-CREAMM amendments, particularly for safety-sensitive positions. The framework requires impairment-based determinations rather than the historical positive-test-equals-cause framework.

Federal Employment / Security Clearance

Federal employers and contractors retain federal-law-driven restrictions independent of NJ state legalization.
