When to Hire a NJ Traffic Infraction Lawyer

Most NJ traffic tickets do not require a lawyer. A simple 2-point speeding ticket with no abstract pressure can be paid by mail. Some tickets, on the other hand, can disqualify a CDL, trigger thousands of dollars in surcharges, suspend a license, or generate insurance-premium uplifts that exceed the lawyer’s fee many times over. When You Probably Need a Lawyer
The high-stakes triggers:
1. CDL Holder
Any moving violation in any vehicle. CDL disqualification at the serious-traffic-violation level is two violations within 3 years = 60-day disqualification. Defending each one matters.
2. Existing Points Near 6 or 12
If you’re at 4 points and a new 4-point conviction would push you to 8 — past the 6-point surcharge trigger — defense pays for itself.
3. License Currently Suspended or Restored Recently
Any N.J.S.A. 39:3-40 matter. Especially the DWI-related-suspension subset under 39:3-40(f)(2) with mandatory jail.
4. Reckless Driving

5. Speeding 30+ MPH Over

6. Leaving the Scene with Injury
8 points + indictable-grade exposure under N.J.S.A. 39:4-129(a). Always counsel.
7. Hit-and-Run or Accident-Related Charges
Where a property-damage accident has been charged, the hit-and-run exposure is real.
8. DWI / Refusal
Always counsel. The collateral consequences (insurance, ignition-interlock, surcharge, employment) compound the direct sanctions.
When You Probably Don’t
1. Single 2-Point Ticket on a Clean Record
Pay it, take a defensive-driving course later if needed.
2. Parking Tickets
Self-handle.
3. Equipment Violations
Typically resolvable with the inspection paperwork.
What a Traffic Lawyer Actually Does
1. Discovery Audit
Pulls the radar/lidar maintenance log, the operator certification, the dashcam if available.
2. Plea Negotiation
Argues for amendment to a no-point alternative — typically N.J.S.A. 39:4-97.2 unsafe operation.
3. Trial Preparation
When the prosecutor will not amend, the lawyer prepares trial. Some traffic cases are won at trial when the State cannot lay foundation.
4. Sentencing Mitigation
For matters resolving by plea or trial loss, mitigation work on fines, license-impact, and any jail exposure.
