FRO Vacatur in Bergen Superior — A Carfagno Modification Approach

The case-type framing. A Final Restraining Order entered under the Prevention of Domestic Violence Act is not necessarily permanent. Carfagno v. Carfagno, 288 N.J. Super. 424 (Ch. Div. 1995) established the framework for FRO modification or vacatur on defendant’s application. The defendant must show, by a preponderance, that good cause exists to modify or dissolve the order. The Carfagno court enumerated eleven factors guiding the analysis. Where a defendant has lived peaceably for years post-FRO, has completed any required counseling, and the protected party either consents or does not oppose, vacatur is a realistic remedy. Procedural Posture

Where the protected party affirmatively consents, the application is generally granted. Where the protected party opposes, the hearing proceeds with testimony from both sides.

Resolution Category

In Bergen Carfagno applications where the defendant’s record post-FRO is clean, counseling is documented, and the protected party either consents or does not present a continuing fear basis, the resolution category is FRO vacatur. Where the application is denied, the FRO continues; the defendant may re-apply at an appropriate later interval.
